A Cicero man accused of fleeing police after pointing a gun at another motorist during a road rage incident was denied a pretrial release, according to the DuPage County State’s Attorney’s Office.

Jose Guitierrez, 31, of Cicero, was charged with two counts of aggravated fleeing and eluding a police officer, one count of aggravated unlawful possession of a weapon, and several misdemeanor offenses such as aggravated assault, resisting a police officer, reckless driving, and transportation of open alcohol by a driver.

On Friday evening, Naperville police responded to a road rage incident near Naper Boulevard and Plank Road in which Gutierrez allegedly pointed a weapon at another driver. Later, a police officer stopped Gutierrez’s car. According to sources, Gutierrez came to a stop before departing the scene. Police tried several techniques to stop Gutierrez, but he proceeded to run at high speeds on I-88, I-355, Finley Road, and Roosevelt Road, where he ran over a second stop sign.

Guitierrez drove eastbound on Roosevelt Road at high speeds while on his rims until he came to a stop. Guitierrez was then captured by police after allegedly fleeing the area on foot.

Officers discovered a loaded Phoenix Arms .22-caliber handgun, which Gutierrez allegedly flung out of his car. There was also ammunition found.

What they’re saying:  “I want to remind motorists that in DuPage County we will not tolerate the type of reckless behavior alleged in this case that puts not only the accused at risk, but also the officers involved as well as the motoring public,” DuPage County State’s Attorney Robert Berlin said. “As I’ve said in the past but bears repeating, if you hear sirens and see lights behind you, pull over. Do not attempt to outrun the police as you will not be successful and will only make matters worse for yourself.”

What’s next: Guiterrez’s next court date is set for Monday.
